The police found Mr M riding his mobility scooter along a local High Street steering with one hand while the other clutched a can of strong lager…
He provided a (very) positive breath test.
Was he guilty of driving with excess alcohol?
No he wasn’t.
Instead, our client was charged under section 12 of the Licensing Act 1872 with being drunk in charge of a carriage.
Outcome – fined £50, no disqualification.
This legislation also applies to those in charge of any horse, cattle or steam engine on a highway or other public place.
Be careful out there.
